You acknowledge and agree that your use of the Internet and access to the App is solely at your own risk. You should also understand that the confidentiality of any communication or material transmitted to/from the App over the Internet or other form of global communication network cannot be guaranteed.
In connection with your use of the App and/or the Services, you acknowledge and agree that you will not:
Without limiting the generality of the foregoing, copying or reproducing any services, programs, products, information or materials provided by everyday health to any other server or location for further reproduction or redistribution is expressly prohibited.
Certain products or services may be offered for sale on the App or through the Services. If a personnel wishes to purchase or to subscribe for any of these products or services, you will be requested by The Kidzit or an authorized third party to share certain personal information which shall be accurate, complete and current. You agree to comply with the terms and conditions of any agreement that you may enter into governing your purchase of the product or service and shall be responsible for the charges and any applicable taxes.
In the event that access to an applicable Service requires a recurring payment, you agree that we (or our third party payment service provider) may automatically invoice your account at the beginning of each recurring period. We reserve the right to increase charges and fees, or to institute new charges or fees at any time, without prior or advance notice communicated to you through such means as we may deem appropriate from time to time.
Right to use a paid service or a specific product is conditional upon our receipt of payment. If payment cannot be charged to your credit card or if a charge is refunded for any reason, including chargeback, we reserve the right to either suspend or terminate your access and account.
Any opinions, advice, statements, services, advertisements, offers or other information or content expressed or made available through the App by third parties, including information providers, are those of the respective authors or distributors. Neither The Kidzit, its Licensors nor any third-party content providers guarantee the accuracy, completeness or usefulness of any content. Furthermore, neither The Kidzit nor its Licensors endorse or are responsible for the accuracy and reliability of any opinion, advice or statement made on any of the App or Services.
You may be exposed through the App or Services to content that violates our policies, is sexually explicit or is otherwise offensive and hence you access the App at your own discretion and risk. We take no responsibility for your exposure to third party content on the App or the Services. It should be understood that we do not advocate the use of any product or procedure described in the App or through the Services, nor are we responsible for misuse of a product or procedure due to typographical error.
We reserve the right to change, modify, add or remove portions of these terms at any time and without prior notice, and any changes will become effective immediately upon being posted unless we advise you otherwise. The use of the App or Services after these amended terms shall be deemed to be your continued acceptance of the terms and conditions of these terms.
The App or Services require you to open an account, you must complete the registration process by providing The Kidzit with current, complete and accurate information, as prompted by the applicable registration form. The Kidzit reserves the right to terminate your access and use of the App and/or the Services. As part of the registration process, you will be asked to select a username and password. You are entirely responsible for maintaining the security and confidentiality of your account and password.
Furthermore, you are entirely responsible for any and all activities and conduct, whether by you or anyone else, that are conducted through your account.
Neither The Kidzit nor its Licensors will be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. You may be held liable for any losses incurred by The Kidzit, its Licensors or another party due to someone else using your account or password.
Participation, correspondence or business dealings with any third party found on or through our Sites and Services, including, without limitation, advertisers and other users, regarding payment and delivery of specific goods and services, and any other terms, conditions, representations or warranties associated with such dealings are solely between you and such a third party.
You agree that The Kidzit shall not be responsible or liable for any loss, damage, or other matters of any sort incurred as the result of such dealings.
Neither The Kidzit nor its owners, licensors, employees or sponsors are responsible or liable to anyone else for any loss or injury or any indirect, incidental, consequential, special, punitive or other damages under any contract.
The Kidzit shall not be liable to the user for any claims, liabilities, losses, damages, costs or expenses arising under or in connection with the contract for any amount in excess of the amount paid by the user to The Kidzit, except to the extent it is finally determined to have resulted primarily from the fraud of The Kidzit.
The user shall indemnify and hold harmless The Kidzit and any owners, licensors, and employees of The Kidzit from all third party claims except to the extent finally determined to have resulted primarily from fraud of The Kidzit. In circumstances where all or any portion of the provisions of this Paragraph are finally determined to be unavailable, the aggregate liability of The Kidzit (including their respective personnel) for any Claim shall not exceed an amount which is proportional to the relative fault that their conduct bears to all other conduct giving rise to such claims.
The Kidzit makes no representation or warranty that the content and materials on the App or the Services are appropriate or available for use in locations outside India. Those who choose to access the Sites or use the Services from other locations do so on their own initiative and at their own risk, and are responsible for compliance with local laws, if and to the extent applicable. The Kidzit reserves the right, at any time in our sole discretion, to limit the availability and accessibility of the Sites or the Services to any person, geographic area or jurisdiction we so desire, and to limit the quantities of any such service or products that we provide.
Any legal proceeding taken/submitted in the court of law only be accepted in the local jurisdiction of Pune, India.
You agree that The Kidzit, in its sole discretion, may terminate your password, account (in whole or in part) or use of the Sites or Services, and remove and discard any content within the Sites or Services, at any time and for any reason. You agree that any actions taken under this Section may be effective without prior notice to you.
These terms and the relationship between you and The Kidzit shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. You and The Kidzit irrevocably agree to submit to the personal and exclusive jurisdiction of the courts located within India, and waive any jurisdictional, venue or inconvenient forum objections to such courts.
We may modify these terms at any time, as we deem appropriate. If you disagree with the changes to the terms, you must discontinue your use of the Sites and Services, and if you have registered as a member, cancel your registration. Your continued access or use of any of the Sites or Services following such notice signifies your acceptance of the modified terms. It is your responsibility to review the terms regularly to be aware of such modifications. We reserve the right to modify or discontinue the Sites or Services with or without notice. We will not be liable to you or any third party should we exercise our right to modify or discontinue the Sites or Services. If you object to any such changes, your sole recourse will be to cease access to the Sites or Services. Continued access to the Sites or Services following notice of any such changes will indicate your acknowledgement of such changes and acceptance of the Sites or Services as so modified and your use of new Services will be governed by these terms.
You may purchase the Premium subscription directly from The Kidzit or through a third party by paying a subscription fee plus applicable taxes in advance on a monthly basis or some other recurring interval disclosed to you prior to your purchase.
Some of our subscriptions include a trial period, where you can experience the application for a specified period at no cost or at a reduced price ("Trial"). Subscription with the Trial period will notify you to subscribe to a paid subscription once your Trial expires. If you purchase access to the Premium content or services through a third party, separate terms and conditions with such third party may apply in addition to these terms. There is no refund once the payment is made.
The Kidzit may from time to time make changes to subscription plans, including subscription fees and will update any price changes in the payment section. Price changes will take effect at the start of the next subscription period following the date of the price change and, by continuing to use the The Kidzit subscription plans after the price change takes effect, you will have accepted the new price. If you don't agree to a price change, you can reject the change by unsubscribing from the applicable Premium subscription prior to the price change going into effect.
Tax rates or other fees are based on the rates applicable at the time of your quarterly charge. These amounts can change over time with local tax requirements in your country, state, territory, county, or city. Any change in tax rate will be automatically applied based on the account information you provide.
Your payment to The Kidzit or the third party through which you purchased the Paid subscription will not renew automatically at the end of the applicable subscription period. You will have to choose the plan manually in the payment section mentioned in the app, as the app provides paid subscription data per three months and per six months respectively. You need not subscribe for the paid subscription plan after your prior subscription is over, if you do not wish to continue with the paid subscription and yet enjoy the free app till the app serves your purpose.
Use of this site will indicate you have read and understood all of the foregoing "Legal Disclaimer" and the terms and conditions stated therein to be fair and reasonable, and agree to abide by all of the terms and conditions stated therein.
We stand behind our product and your satisfaction with it is important. However because our product is a digital good delivered via internet download we offer no refunds. Hence Payments referred to herein shall be non-refundable, irrevocable or non-credited under any circumstances. Refund requests in any case will not be accepted or entertained.
